Kalekeni Kaphale bags a PhD in Law from Nottingham Law School in UK

Malawi’s vibrant legal mind and the country’s former Attorney General, Kalekeni Kaphale has obtained a landmark ultimate academic achievement by bagging home a PhD in Law at one of world’s prestigious law schools, The Nottingham Law School (NLS) of the Nottingham Trent University in the United Kingdom (UK).

An astute private legal practitioner, Kaphale, a Senior Counsel (SC) and a former law lecturer at the University of Malawi’s Chancellor College graduated on Monday afternoon at the Nottingham Trent University in East Midlands, England in a colourful ceremony.

In an interview Dr. Kaphale said his  thesis was in the fields of insolvency law, conflict of laws and community law. 

“My three year academic journey interrogated whether it was necessary to harmonize transaction avoidance rules in insolvency laws of member states of the Common Market for Eastern and Southern Africa,” said Kaphale.

Having found a case for the harmonization of the rules, Kaphale said he then made a proposal on how best to undertake the process seeing as the rules were found to be very divergent. 

Kaphale said: “The resultant proposition was the design of a harmonization of laws scheme that can work for not only insolvency rules but other fields of law, and can be replicated across regional economic communities all over the world.”

Dr. Kaphale emphasised on the need for quality higher legal education among legal practitioners in the country for quality service delivery.

He said: “A little more education is always important in any professional field. The PhD challenges you to engage in critical thinking and rather than merely focusing on what the law is, you then embark on an exercise devising ways to improve the current legal situation for the betterment of humankind.” 

Dr. Kaphale acknowledged that the challenge is an uphill task but that it is an enjoyable journey of learning saying he loved every moment of the process.

“Days when we thrived using a Bachelors degree only are long past,” said  Dr. Kaphale.

Dr. Kaphale who was part of defence team for the landmark 2020 elections case said there are new problems in society that require new solutions, which can only be devised by those with a philosophical pedigree. 

He said that what we (in Malawi) think are local legal problems or issues are in reality problems that exist is societies at the same level of development and hence the need for problems solvers with a cosmopolitan outlook. 

“Young people need to take the challenge and gain acceptability at a higher level and enjoy worldwide validation. Its always cool to have your head above the average guy next to you, is not it?” queried Dr. Kaphale.

Who is Dr. Kalekeni Kaphale?

Born in 1969 in Blantyre Malawi, Dr. Kalekeni Kaphale, SC graduated in 1991 from the University of Malawi, Chancellor College, with an Upper Second-Class Honours Bachelor’s Degree in Law. 

Dr. Kaphale holds a certificate in the Taxation of International Transactions from the Commonwealth Tax Academy, Malaysia; a certificate in Advanced Trial Advocacy from the General Council of South African Bar Associations and a Master of Laws Degree in Commercial Law from the University of Malawi, Chancellor College, which he obtained with a distinction in 2015. 

In October, 2024 he successfully defended his PhD thesis with Nottingham Trent University of the United Kingdom and graduated on July 28th 2025.

Dr. Kaphale, SC has twice served as Attorney General of the Republic of Malawi and as Vice President of the Malawi Law Society.

He was also a member of the Judicial Service Commission from 2004 to 2014. 

He taught the law of Evidence, Advocacy and Ethics as an adjunct member of the Faculty of Law of the University of Malawi for 10 academic years.

He has worked in private law firms as well as in the public sector, the public service being with the Malawi Revenue Authority, as their Chief Legal Counsel, and as Attorney General of the Republic of Malawi as stated above.

He has litigated extensively in both private and public law at all levels including in the Malawi Supreme Court of Appeal as well as in the courts of the regional economic body, the Common Market for Eastern and Southern Africa.

Apart from litigating in the courts, he also has arbitration experience. He served as an arbitrator in the dispute between a main contractor and a sub-contractor of the Kamuzu Highway (Chichiri to Limbe) road construction contract.

He has also appeared as an attorney for parties to arbitration disputes, quite apart from representing parties in challenges against arbitrators for misconduct.

He was honoured the status of Senior Counsel (the equivalent of Kings Counsel in England) in 2015.

In total he has accumulated 33 years’ experience at the Malawi Bar in March, 2025.
